Laws & Regulations on Workplace Sexual Harassment Prevention
This page summarises key legal frameworks that guide POSH training, employer duties, Internal Committee functioning, and complaint redressal in India. Always verify the latest official text of statutes, rules, and judicial directions for your organisation.
PoSH Act, 2013
The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 requires employers to prevent sexual harassment, prohibit such conduct, and provide a fair redressal mechanism through an Internal Committee or Local Committee, as applicable.
PoSH Rules, 2013
The Rules provide procedural guidance on complaint handling, conciliation, inquiry, confidentiality, and related compliance steps that every workplace POSH policy and Internal Committee process should reflect.
Key Employer Duties
- Provide a safe working environment and display the PoSH policy and penal consequences.
- Constitute an Internal Committee where legally required and support its independent functioning.
- Organise regular POSH awareness and sensitisation programmes.
- Assist the aggrieved woman and protect confidentiality during proceedings.
- Act on IC recommendations within statutory timelines and maintain required reports.
